Smucker Reintroduces Bipartisan ENABLE Act Supporting Individuals with Disabilities

WASHINGTON – Reps. Lloyd Smucker (PA-11) and Don Beyer (VA-08), both members of the House Ways and Means Committee, have introduced the Ensuring Nationwide Access to Better Life Experience (ENABLE) Act bipartisan legislation aimed at helping individuals with disabilities save for their futures by permanently extending key tax provisions set to expire in 2025.

The ENABLE Act strengthens the Achieving a Better Life Experience (ABLE) Act, a 2014 law that allows individuals with disabilities and their families to save and invest in tax-advantaged accounts without jeopardizing their eligibility for essential federal support programs like Medicaid and Supplemental Security Income (SSI). Since its enactment, ABLE accounts have grown significantly, with more than 162,000 accounts now holding a collective $1.7 billion—an average balance of nearly $11,000 per account.

The bill ensures the continuation of three key tax provisions supporting ABLE accounts:

  • Increased Contribution Limits – Employed individuals with disabilities can contribute additional funds to their ABLE accounts.
  • Saver’s Credit – Maintains eligibility for a non-refundable tax credit of up to $1,000 for contributions.
  • 529 Rollovers – Preserves the ability to roll over funds from 529 education savings accounts into ABLE accounts.

The ENABLE Act ensures they can continue saving and investing without fear of losing critical benefits. I encourage my colleagues to support this bipartisan legislation,” said Rep. Don Beyer. “Our legislation would permanently extend three temporary improvements that dramatically expanded the reach and effectiveness of ABLE accounts, facilitating long-term saving and helping individuals with disabilities build an independent financial future.”

Those who work closely with individuals utilizing ABLE accounts are calling for the legislation’s passage. 

“ABLE accounts empower Americans with disabilities to save for the future and live more independently,” said Pennsylvania Treasurer and PA ABLE administrator Stacy Garrity. “Pennsylvania has one of the largest ABLE programs in the country and the ENABLE Act is needed to ensure the great benefits and advantages of these programs continues. Saving without fear of losing access to critical benefits is something our friends and neighbors with disabilities deserve. We must get this across the finish line. I commend Congressmen Smucker and Beyer for their great bipartisan work on this issue.”
